On January 30, 2024, USCIS announced that the initial registration period for the FY 2025 H-1B cap will open at noon Eastern on March 6, 2024, and run through noon Eastern on March 22, 2024. During this period, prospective petitioners and their representatives (if applicable) must register each H-1B beneficiary electronically and pay the registration fee using a USCIS online account. In addition, USCIS has announced to implement the following changes for the FY 2025 H-1B registrations and petitions.
On February 28, 2024, USCIS will launch the new organizational accounts in the USCIS online account. The organizational accounts will allow multiple people within a sponsoring organization (administrators who have authorities to sign, pay, and submit on behalf of the company and members who assist the administrators) and their legal representative (attorneys and paralegals) to collaborate on and prepare H-1B registrations, H-1B petitions, and any associated Form I-907 applications.
An organization’s existing USCIS online account will be upgraded to the organizational account when the organization logs into the account after the launch of the organizational account. An organization must set up at least one company group and one administrator, who may invite other organization staff as administrators or members. Likewise, a legal representative may invite paralegals to help prepare H-1B registrations and petition drafts. An administrator or a legal representative may invite each other to link their accounts for the H-1B registration and petition filings.
Online Filings for Forms I-129 and I-907
On February 28, 2024, USCIS will also launch online filing of Form I-129 and associated Form I-907. Starting April 1, 2024, USCIS will accept online filing for H-1B cap petitions and associated Form I-907. Though petitioners and representatives may continue to file a paper Form I-129 petition and associated Form I-907 request, those petition/request will not be linked to their online accounts.
New Edition of Form I-129
USCIS will introduce a new edition of Form I-129 (edition date 04/01/24), which will soon be available to preview on uscis.gov. Starting April 1, 2024, USCIS accepts only the 04/01/24 edition of Form I-129.
Filing Fee Increases
Starting April 1, 2024, the filing fee of Form I-129 for an H-1B petition will increase from $460 to $780 for petitioners except small employers and nonprofits. Starting February 26, 2024, the premium processing fees for an H-1B petition will also increase from $2,500 to $2,805. The registration fee during the registration period starting in March 2024, will remain $10. However, after April 1, 2024, the registration fee will also increase from $10 to $215. USCIS will reject an H-1B petition and premium processing request with incorrect filing fees.
